William R. Burns

Artesian

William R. Burns, 83, Artesian died Thursday, Aug. 8, 2013 at his residence surrounded by his family.
A private family inurnment will be held at a later date at Morgan Cemetery, Fedora.
William Robert Burns was born May 12, 1930 at Belevidere to Frank and Elma (Stanlake) Burns. He was raised in several locations in South Dakota and attended Mitchell High School. He married Violet Gerstenecker on June 12, 1950 at the Methodist Church in Pipestone, Minn.
Bill worked at various jobs and later as a welder at Trail King in Mitchell.
He loved to fish and enjoyed helping out people with work.
He was preceded in death by his parents; a son, Buddy; an infant daughter; and two half-sisters.
He is survived by his wife, Violet of Artesian; two daughters, Betty Eddy of Virginia and Bonnie Kidder of Howard; his beloved granddaughter, Candy (Jesse) Kreger of Estelline; four grandchildren; six great-grandchildren; and special friend, Raymond Mathis.

Inez Spence

Inez Hilda Orth Spence, 87, died Aug. 7, 2013 in Pathways Hospice, Loveland, Colo., after a two week illness
A private funeral was held Saturday in her daughter’s home.
Inez was born on May 19, 1926 to Henry and Christina Dietrich Orth at Alpena. She was a schoolteacher for over 10 years.
She married Elmer Schnabel in 1947 and lived at Huron from 1955 to 1973, where she worked at the Huron Daily Plainsman and The Plains They divorced in 1973.
In 1974 she met and married Jack Spence in California. They ran a few different service stations in Fort Collins, Colo.
She later worked at the Cancun Resort in Las Vegas.
She was preceded in death by her parents and all six of her sisters.
She is survived by her daughter, Peggy (Richard) Hohm of Fort Collins; two granddaughters; and two great-grandchildren.

The regular meeting of the Woonsocket City Council was called to order by Mayor Lindy Peterson at 7:00 p.m. Monday, August 5, 2013 with the following members present: Richard Reider, Richard Regynski, John Ames, Don Schmidt, Brandon Goergen and Jim Steichen.
Motion by Schmidt, seconded by Goergen, to approve the agenda. Motion carried.
Motion by Ames, seconded by Steichen, to approve the July 1, 2013 Minutes.  Motion carried.

Council discussed water rates and water meters. More discussion will be held next month.
Motion by Schmidt, seconded by Goergen, to accept the petition that was filed by a resident in regards to vacating the City roadway, which exists between Lots Four through Eleven (4-11), inclusive, Block Ninety (90) of the First Addition of the City of Woonsocket, Sanborn County, South Dakota, and the North Seventy-Five Feet (N.75’) of the Lots Five through Ten (5-10), inclusive, Block One Hundred (100) of the First Addition of the City of Woonsocket, Sanborn County, South Dakota. A public hearing was set for September 9th at 7:30 p.m. Motion carried.
Motion by Regynski, seconded by Steichen, to approve the second reading of Ordinance 93-19 as amended. Motion carried.
AMENDMENT TO
ORDINANCE NO. 93-19
ADDING SECTION 4 RELATING TO VICIOUS OR DISEASED ANIMALS AND AMENDING PREVIOUS SECTION 4 TO SECTION 5 RELATING TO PENALTY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WOONSOCKET, SOUTH DAKOTA:
1. That section 4 of Ordinance No. 93-19 shall be added to read as follows, to-wit:
“Section 4. Vicious or Diseased Animals
A. Vicious animals prohibited. It shall be unlawful for any person to keep, maintain or have in their possession or under their control within the city any vicious animal.
B. Vicious animal defined. Any animal which, according to records of the appropriate authority, has inflicted serious injury on a human being on public or private property. Any animal, according to records of appropriate authority, has killed or seriously injured a domestic animal while OFF of the owners property. Any animal owned or harbored primarily or in part for the purpose of fighting, or any animal trained for fighting. Any animal which chases or approaches a person upon the streets, sidewalks, or any public or private property in a menacing fashion or apparent attitude of attack.
Any animal of a known propensity, tendency, or disposition to attack, to cause injury, or to otherwise threaten the safety of human beings or animals.”
AMENDING SECTION 4 TO SECTION 5
2. That Section 5 of Ordinance No. 93-19 shall be added to read as follows, to-wit:
“Section 5. PENALTY: Any person violating any of the provisions of this Chapter, shall, upon a first conviction thereof, be punished by a fine of One Hundred Dollars ($100); upon a second conviction, a fine of Two Hundred Fifty Dollars ($250) and upon a third conviction, a fine of Five Hundred Dollars ($500) and up to thirty (30) days in jail.”
This Ordinance shall take effect and be in force from and after its passage, approval and publication.

NEW BUSINESS
Motion by Ames, seconded by Schmidt, to approve the temporary easement as set forth in the agreement with the State of South Dakota located over and across the real property as described: Lot 13 in Block 32; Lot 24 in Block 32; and Lot 18 in Block 33 original Town of Woonsocket, Sanborn County, South Dakota in the amount of Five Hundred Dollars ($500.00). Motion carried.
Council discussed cleaning up a residence in the community. Tabled.
The Council held discussions on the following items: ditch north of town, city building, storm drain and lagoon land.
With no further business to be discussed. Motion by Reider, seconded by Schmidt to adjourn the meeting. Meeting adjourned at 9:10 p.m.
