A Mitchell man was sentenced Aug. 1 for the rape of an underage Sanborn County female last summer.
Kyle Larson, 20, of Mitchell, pled guilty April 25 to fourth degree rape of a 15-year-old girl. He was sentenced to six years in the State Penitentiary, with none of the time suspended, by Judge Jon Erickson, and ordered to pay $104 in court costs.
State’s Attorney Jeff Larson commented on the case, saying, “The victim was a local Sanborn County girl, who we commend for doing everything right in such a situation…. it is hard to believe in 2017, she actually had to suffer several harassing comments since the attack, suggesting that she was at fault. She was forcibly raped and…. Mr. Larson’s sentence was fair and just.
“He will be on the sex offender registry, and is barred from having any contact with the victim,” Jeff Larson added.
The rape occurred on July 20, 2016, and Kyle Larson was originally indicted Aug. 10, 2016, and pled not-guilty, for second degree rape by the use of force, a Class 1 felony, and third degree rape by completing the act with someone incapable of consent, a Class 2 felony.
Larson pled guilty to fourth degree rape, which is a Class 3 felony and could have been sentenced to up to 15 years in prison and a $30,000 fine.
