THE SANBORN COUNTY Commissioners, governing board of Sanborn County, South Dakota, state that the above said board is unable to properly maintain, repair, construct, and reconstruct roads and bridges in SANBORN COUNTY.  Law now permits the governing board of SANBORN COUNTY to establish a tax amount which may be levied and such amount can increase each year with the amount of inflation and new construction. Therefore, the board does now establish a base property tax in the amount of eighty cents ($.80) per One Thousand Dollars Valuation starting with calendar year 2024, taxes payable in the calendar year 2025.  This action has been taken by the board and approved by at least a two-thirds vote of the board. 

This decision may be referred to a vote of the people upon a petition signed by at least five percent of the registered voters in the district and filed with the governing body within twenty days of the first publication of this decision.

Unless this action is referred to a vote of the people and reversed by such vote, the resolution authorizes the county auditor to spread a levy to raise tax dollars in the above stated amount, and allowing for percentage increases from inflation and new construction in subsequent years, as according to Resolution #2024-5.

HIGHWAY

Sheri Kogel, Highway Department, met with the board. Motion by S. Larson, seconded by Peterson, to enter into an agreement with South Dakota Department of Transportation for Pavement Markings. Motion carried. The board reviewed the Highway Safety Manual with some updates to the manual as recommended by Safety Benefits. Motion by Peterson, seconded by S. Larson, to approve the additions made to the highway safety manual by Resolution 2024-12. Motion carried.

SPEED LIMIT ON 236TH STREET

Brenda Fagerhaug was present to continue to express her concerns regarding the speed limit on 236th Street, in the ¾ mile by Twin Lakes. Fagerhaug proposed that the speed limit be reduced to 20 to 30 mph zone through the residential area. The board will be putting up children at play signs, as soon as they arrive, and will place traffic counters later in the spring/summer, to help determine if reducing the speed is necessary. 

RESOLUTION 2024-5 – ESTABLISHING A ROAD AND BRIDGE LEVY

Motion by Blindauer, seconded by P. Larson, to approve Resolution 2024-5 to establish a Road and Bridge Levy. This levy would replace the current opt-out levy of $350,000, and will not be in addition to the current levy. 

WHEREAS, Sanborn County has deteriorating and substandard county roads and bridges; and 

WHEREAS Sanborn County has inadequate revenue to meet the minimum road and bridge maintenance required; and

WHEREAS, SDCL 10-12-13 allows the Board of County Commissioners to establish a levy for the creation of a reserve fund to be accumulated and used for the purpose of maintaining, repairing, constructing and reconstructing roads and bridges in Sanborn County; and 

WHEREAS taxable valuation within Sanborn County is less than one billion dollars;

THEREFORE, BE IT RESOLVED, by the Sanborn County Board of Commissioners that there shall be an increased levy in the amount of Eighty – Cents ($.80) per one thousand dollars of taxable valuation of property located within Sanborn County; and that the monies from the levy shall be placed into a reserve fund known as the Sanborn County Highway and Bridge Reserve fund; and be it further;

RESOLVED that said funds shall be used solely for county road and bridge purposes, and that the County Highway budget shall not be reduced on account of the special funds available.

OTHER BUSINESS BROUGHT BEFORE THE BOARD 

Auditor Moody received the 2024 Nurse’s contract with the South Dakota Department of Health. Discussion was had, but no action taken. Contract will be reviewed again at the meeting on April 16th.   

Motion by S. Larson, seconded by P. Larson, to enter recess at 11:42 a.m., to go to the 4-H building to meet with Summit Contracting for a walk-through of the addition before signing off on the completion of the project. Motion carried.

SUMMIT CONTRACTING

Steven Bultsma and Dusty Kusser, Summit Contracting, Jamie Miller, Scott Senska, Andy Ettswold and Paula Linke were all present at the 4-H building. There were some concerns expressed with Summit Contracting regarding how things were completed. Summit Contracting will make the requested changes prior to Sanborn County paying the final bill and signing off on the completion of the project. 

There being no further business before the board, motion by S. Larson, seconded by P. Larson, to adjourn the meeting at 2:09 p.m. Motion carried.

Woonsocket Restricted Use Solid Waste Facility By the Department of Agriculture and Natural Resources

The South Dakota Department of Agriculture and Natural Resources (DANR) has received a permit renewal application from the city of Woonsocket to continue operation of a Type IV Restricted Use Solid Waste Facility located ½ a mile west of Woonsocket. The legal description is the NW1/4 NW1/4 SW1/4 of Sec 21, T107N, R62W, Sanborn County, South Dakota. The total acreage of the site is 5.00 acres.  The facility will serve the city of Woonsocket and the surrounding area.  The permit renewal will be granted for a period of five years as provided for under SDCL 34A-6-1.16.

DANR has reviewed the application and information submitted, has reached a tentative decision and recommends to the Board of Minerals and Environment (board) that the permit be issued to the applicant to operate the solid waste facility.

The recommendation for approval of this permit is subject to the applicant’s compliance with the Administrative Rules of South Dakota (ARSD) 74:27 and a total of 32 permit conditions.  The permit conditions include general requirements (10 conditions), design and construction requirements (3 conditions), operating requirements (9 conditions), recordkeeping and reporting (2 conditions), closure requirements (7 conditions), and financial assurance (1 condition) as have been determined to be necessary to ensure the facility complies with the environmental laws of this state.

In accordance with SDCL 34A-6-1.14, DANR’s recommendation for approval will become the final decision of the permit application and this permit will be issued 30 days after publication of this notice.  A person adversely affected or having an interest adversely affected by the DANR’s recommendation for approval may petition the board for a contested case hearing.  The petition must comply with the requirements of ARSD 74:09:01:01.  If a petition for such a hearing is not filed within 30 days of this publication date, a permit will be formally and finally granted at that time.
