Sanborn County Commissioners met in regular session on Tuesday, March 4, 2025, at 9:00 a.m., with Chairman Jeff Ebersdorfer presiding. Present were Steve Larson, Earl Hinricher, Gary Blindauer, and Duane Peterson. Auditor Kami Moody was also present. Motion by Peterson, seconded by Blindauer, to approve the minutes from January 21 meeting, as presented. Motion carried. Motion by Peterson, seconded by Blindauer, to approve the agenda as amended by removing Lori Cowman from the agenda due to road conditions. Motion carried.

HIGHWAY:
Stacey Mendenhall and Sheri Kogel, Highway Department, met with the board. There was discussion on the Pudge Pit for gravel purposes. Motion by Hinricher, seconded by Larson, to enter into agreement with the State Department of Transportation for a joint power’s agreement. Motion carried.
Motion by Hinricher, seconded by Blindauer, to sign Resolution 2025-4 for County Weight Limit Resolution. Motion carried.
SANBORN COUNTY WEIGHT LIMIT ENFORCEMENT
RESOLUTION
RESOLUTION # 2025-4
WHEREAS, excessive loads can be detrimental to our highways, and
WHEREAS, the Sanborn County Board of County Commissioners, desires to protect existing Sanborn County Highways, ultimately saving tax dollars and,
WHEREAS, the Sanborn County Board of County Commissioners, desire the enforcement of weight limitations on Sanborn County Roads as set forth and posted by the Sanborn County Highway Superintendent, when the superintendent deems it necessary.
NOW therefore to be resolved;
WHEREAS, the limits on Sanborn County Highways shall be set as 80,000 pounds gross weight for any vehicle or combination of vehicles and a maximum truck speed of 40 miles per hour, on County Road, 09-O (397th Ave – Mt Vernon Oil).
That the South Dakota Highway Patrol is and hereby is authorized and requested to enforce weight limitations on Sanborn County Roads.
Be it further resolved that the penalty for the violation of the load restrictions shall be as set forth in SDCL 32-22-55.
Vote of Sanborn County Commissioners: AYE 5, NAY 0.

• Hallaway Construction – Bid was placed with a breakdown of equipment use and labor costs.
Motion by Hinricher, seconded by Peterson, to accept the Hallaway Construction bid. Bid breakdown is available in the Auditor’s office for viewing purposes. Motion carried.
MARIA SCHWADER, LEGISLATIVE AUDIT
Schwader was present to give the commissioners the final report from the 2022 and 2023 audit. Motion by Hinricher, seconded by Peterson, to approve the audit report presented by Legislative Audit. Motion carried.
LORI COWMAN, DISTRICT III
Due to weather conditions, Cowman was unable to make it to the meeting. Cowman has rescheduled.
BURN BAN – RESOLUTION 2025-3
At the request of the local fire departments, a motion by Blindauer, seconded by Peterson, to accept Resolution 2025-3 to enforce a Sanborn County Burn Ban, effective immediately. Motion carried.
DECLARE A FIRE DANGER EMERGENCY IN SANBORN COUNTY AND TO PROHIBIT OPEN BURNING
WHEREAS, the Sanborn County Board of Commissioners, pursuant to SDCL 7-18A-8, is authorized to adopt emergency measures for the preservation of the public peace and safety, and
WHEREAS, the Sanborn County Board of Commissioners adopted ordinance 2023-10, to regulate open burning procedures and requirements, and
WHEREAS, the Sanborn County Board of Commissioners has determined that because of extremely dry conditions a fire danger emergency now exists within Sanborn County, now,
THEREFORE, BE IT RESOLVED by the Sanborn County Board of Commissioners that a “FIRE DANGER EMERGENCY” be declared and that all open burning of any substance shall be prohibited within Sanborn County, excluding incorporated municipalities, until rescinded by the Sanborn County Commission,
IT IS FURTHER RESOLVED that pursuant to SDCL 7-18A-2 and SDCL 22-6-2(2) the penalty for violating this resolution shall include a fine not to exceed five hundred dollars for each violation.

UPDATING HANDBOOK
Motion by Hinricher, seconded by Blindauer, to approve the changes made to the Personnel Handbook in Section III. Motion carried.
OTHER BUSINESS BROUGHT BEFORE THE BOARD:
Planning & Zoning minutes from March 3 were reviewed, discussed, and approved.
