BE IT ORDAINED by Sanborn County that open burning during Fire Danger Emergencies as defined herein is prohibited in Sanborn County, South Dakota.
Section 1. Statement of purpose.  Pursuant to SDCL 7-8-20 (18) and consistent with SDCL 34-29B-11.1, Sanborn County believes that standard provisions for the declaration of Fire Danger Emergencies will provide an orderly and expeditions process for banning open burning during dry, windy, and other dangerous conditions.
Section 2. Fire Danger Emergency Declaration.  When weather or other conditions exist which may make open burning unduly hazardous, the Sanborn County Board of Commissioners may prohibit or restrict open burning after consultation with local fire officials and law enforcement officials in order to protect the public health and safety.  The Board of Commissioners shall act by resolution declaring a Fire Danger Emergency and prohibiting open burning within any portion or all of Sanborn County until such time as the resolution declaring the Fire Danger Emergency shall have been rescinded or amended.
Section 3. Penalty. Any person who shall create, commit, maintain or permit to be created, committed or maintained any open burn in violation of a resolution declaring a Fire Danger Emergency shall be subject to a maximum penalty of thirty (30) days in jail, a five hundred dollar ($500.00) fine, or both.
